What does it cost to expose evil?
David Daleiden has learned the answer to that question.
His organization, Center for Medical Progress, was responsible for releasing the undercover videos that exposed the sale of aborted baby body parts by Planned Parenthood.
As a result, David has faced a gauntlet of unrelenting retaliation, spending time in prison and facing financial ruin.
But a recent judicial victory has given David cause for hope.
Ever since Center for Medical Progress’ footage exposing the treatment of unborn and aborted babies was released, Planned Parenthood has tried to cover up the horrible truth by accusing the organization of unethical journalism practices.
Planned Parenthood formulated a lawsuit on the grounds that Daleiden and others tried to incite “threats” and “violence” towards the abortion-centric organization.
Never mind that Planned Parenthood is the purveyor of violence in this case.
The videos in question provided graphic proof that Planned Parenthood profited from the sales of fetal tissue and organs from aborted babies. Daleiden and the CMP released the videos in hopes of convincing legislators to defund Planned Parenthood.
The organization accused Daleiden and his colleagues of unethical journalism, arguing that they only wanted to give Planned Parenthood a bad name. To that end, Planned Parenthood sued CMP for over $20 million.
The lawsuit was initially decided in favor of Planned Parenthood. Judges at the district level and in a court of appeals ruled that CMP’s video release was an unethical “infiltration” and condemned Daleiden and his colleagues for trying to incite violence against Planned Parenthood.
Essentially, these judges decided that Planned Parenthood’s right to privacy was more important than the journalists’ exposure of unethical and immoral abortion practices in the clinics.
The Supreme Court had declined to hear CMP’s appeal – but now a federal judge has given new life to the case!
In a startling turn of events, Judge William Orrick III, the most recent judge on the Planned Parenthood vs. CMP case, overturned Planned Parenthood’s smear campaign and claims of defamation.
Judge Orrick, who heard the case when it first came to court, originally issued a restraining order toward CMP.
But he changed his mind during the most recent hearing.
He revealed that he was “inclined to exclude from the case all damages that stem from third parties’ reactions to the release of the video recordings as impermissible damages barred by the First Amendment absent a defamation claim.”
What this means for CMP is that the amount of money involved in the lawsuit is now significantly less than the original $20 million proposed by Planned Parenthood.
Judge Orrick ruled that Planned Parenthood was entitled to less than $100,000 in “damages” that hypothetically stemmed from the release of CMP’s videos—namely, suspicion and anger toward the clinics that reportedly sold aborted fetal body parts.
What’s more important than monetary results in this case, though, is Judge Orrick’s verdict on First Amendment rights and journalism ethics.
Judge Orrick’s decision “affirms that citizen journalists exercising their First Amendment rights to speak and publish cannot be held liable for any bad actions taken by others in the free marketplace of ideas, absent a clear showing of defamation or intent to incite imminent lawless action.”
Citizen journalists, like Daleiden and his colleagues at CMP, who work to expose the immoral practices of organizations like Planned Parenthood, can no longer be blamed for the results of their journalism.
CMP’s journalists have been vindicated of the charges leveled by Planned Parenthood as concerned citizens doing their best to expose the corruption lurking behind the doors of the abortion organization.
This is a victory for life and a victory for freedom of speech!
Daleiden affirmed the importance of Judge Orrick’s decision, saying:
“Now that all the facts, evidence, and testimony are in, even Planned Parenthood’s favorite judge refuses to buy into the abortion giant’s fake news and lies about the honest motives and protected speech of pro-life citizen journalists. Planned Parenthood is a government-sponsored crime syndicate selling baby body parts like widgets on an assembly line and should only appear in federal court as a criminal defendant.”
Planned Parenthood will continue the lawsuit at the reduced level of damages, starting on September 30. The case will be Planned Parenthood Federation of America et al vs. The Center for Medical Progress et al (3:16-cv-00236-WHO).
Keep praying for Daleiden and CMP as they seek to expose the truth of Planned Parenthood, and pray also for those at Planned Parenthood who want to silence them.
